Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the AWE Color Swatches application and related services. By installing or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. The service
AWE Color Swatches provides an application that integrates with and extends Shopify stores. We may update, add, or remove features over time.
2. Eligibility and accounts
To use the app you must have an active Shopify store and accept the applicable Shopify terms. You are responsible for your account, your store, and all activity that occurs through the app.
3. Acceptable use
You agree not to misuse the app, including by violating any law or third-party right, interfering with or disrupting the app or its infrastructure, attempting unauthorized access, or using the app to transmit unlawful, infringing, or harmful content.
4. Fees and billing
If the app offers paid plans, charges are billed through the Shopify billing system and are subject to the applicable Shopify terms. The fees, billing cycle, and any free trial are shown before you approve a charge. You can change or cancel your plan as described in the app. Charges already incurred are non-refundable except where required by law.
5. Intellectual property
We and our licensors own all rights in the app, including its software, design, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the app while these Terms are in effect. You retain all rights in your own store data.
6. Third-party services
The app relies on Shopify and other third-party services. We are not responsible for those services, and your use of them is governed by their own terms.
7. Privacy
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimers
The app is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, AWE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the app. Our total liability for any claim will not exceed the amounts you paid for the app in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold AWE harmless from any claim arising out of your use of the app or your violation of these Terms or applicable law.
11. Term and termination
These Terms apply while the app is installed. You may stop using the app at any time by uninstalling it. We may suspend or terminate access if you breach these Terms or to comply with law. Provisions that by their nature should survive termination will survive.
12. Changes to these terms
We may modify these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and your continued use of the app constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules.
